Terms of Service

1. Introduction

This Terms of Service Agreement (the "Agreement") is entered into between [DevKaus] ("Bot Owner") and the user ("User") of the Eldoria Discord bot (the "Bot"). By using the Bot, the User agrees to be bound by the terms of this Agreement. If the User does not agree to any part of this Agreement, they should immediately discontinue use of the Bot.

2. Use of the Bot

The Bot Owner grants the User a non-exclusive, non-transferable, limited license to use Eldoria for personal or non-commercial purposes within Discord. Any commercial use of Eldoria requires express written consent from the Bot Owner.

3. Prohibited Use

The User may not use the Bot in any way that:

• Violates applicable laws, rules, or regulations.
• Infringes upon the rights of any third party.
• Abuses or exploits the Bot's features for purposes of harassment, spam, or prohibited activity as outlined in Discord's Terms of Service.

4. In-App Purchases

Eldoria offers in-app purchases for digital features and services. Purchases are final, and refunds are not provided except under specific terms detailed in our Payment Terms. Upon completion of payment, Users gain immediate access to digital content. Payment information is handled securely by third-party processors and is not stored on our servers. 5. Limitation of Liability

The Bot Owner shall not be liable for any damages resulting from the use or inability to use the Bot, including, but not limited to, damages for lost profits, loss of data, or other intangible losses.

6. Modifications to the Bot

The Bot Owner reserves the right to modify, update, or discontinue the Bot at any time without notice. The User agrees that the Bot Owner shall not be liable to the User or any third party for any modifications, suspensions, or discontinuation of the Bot or its features.

7. Intellectual Property

The Bot and all associated intellectual property rights remain the property of the Bot Owner. The User agrees not to copy, modify, or distribute Eldoria or any portion of it without express written permission.

8. Indemnification

The User agrees to indemnify and hold harmless the Bot Owner, affiliates, and their respective directors, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of the User's use of the Bot.

9. Termination

This Agreement may be terminated by either party at any time for any reason. Upon termination, the User must immediately cease all use of the Bot.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising under or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the Indian Council of Arbitration (ICA), and the seat of arbitration shall be New Delhi, India. In case of disputes not resolved through arbitration, the courts of New Delhi, India, shall have exclusive jurisdiction.

11. Entire Agreement

This Agreement constitutes the entire agreement between the Bot Owner and the User, superseding any prior agreements, whether written or oral, relating to the Bot.

12. Service Terms

By using Eldoria, you agree to follow these service terms:

• We reserve the right to revoke access to Eldoria at any time for any reason.
• Users must adhere to Discord's rules and guidelines. More information can be found at Discord Terms and Discord Guidelines.
• Virtual currency or items within Eldoria have no real-world monetary value.
• Malicious or illegal use of Eldoria may lead to suspension or termination of access.
• Automated interactions with Eldoria using self-bots, macros, or any non-human input are strictly prohibited and may result in access revocation.

13. Payment Terms

Our Payment Terms for Eldoria are as follows:

• No Refunds: All purchases are non-refundable. Refunds are provided only in limited cases within 7 days, and solely at our discretion, or in cases required by law.
• Chargebacks: Initiating or threatening chargebacks without prior contact may lead to suspension of access to Eldoria.
• Subscriptions: Pro-rata refunds in the form of store credits may be offered beyond 7 days at our discretion for subscriptions only.
• No Guarantee of Permanent Access: Purchasing premium or in-app services does not guarantee permanent access to Eldoria.
• Resale Prohibited: Reselling any purchased features or services is strictly prohibited.

14. User Conduct

When using Eldoria, Users agree to conduct themselves in a manner that upholds community guidelines:

• Respect other users and avoid harassment, abuse, or inappropriate language.
• Use Eldoria's features responsibly, without attempting to manipulate or exploit the bot.
• Avoid sharing or promoting any harmful or prohibited content while interacting with the bot.
